IMPORTANT : The terms and conditions below will govern your agreement with us for the Service. You should ensure that you have read and understood them before you accept our offer to provide the Service to you.

• Definitions

“you” or “your” means you, the person accessing, viewing or using the Site.

“Conditions” means these terms and conditions;

“Personal Information” means the information provided to us in the User Registration Form, and held by us in accordance with the Data Protection Act 1998;

“Privacy Policy” means the Autoweb Privacy Policy as amended from time to time and linked to the Site;

“Services” means the services provided to you through the Site;

“Site” means the website at url www.autoweb.co.uk or such other URLs or domain names as are from time to time, owned and made available by Autoweb.

• Services
• Upon receipt of your User Registration Form we will e-mail to you a Vehicle Upload Form on which to provide details of any vehicle you wish to advertise for sale. Once completed and returned to us we will enter the details of the vehicle into our on-line database.
• Our on-line database is accessible to all visitors to the Site and contains details of vehicles listed for sale together with a contact telephone number of the seller.

• Your Obligations
• You must ensure that the information provided to us, is true and accurate. You are responsible for promptly notifying us of any change in your address, contact details, vehicle details or of a sale of the vehicle.
• It is your responsibility to verify any information that you may obtain from the Site with independent sources before acting on it. It is also your responsibility to use suitable anti-virus software in any material that you may download from the Site, or any site linked to it, and to ensure the compatibility of such software with your equipment.

• Intellectual Property
• All rights in copyright, trademarks or other intellectual property attaching to the Site, [(including the database)] whether registered or unregistered are owned by us, or licensed to us. To the best of our knowledge, the material used by Partners is owned by them, and they have granted a licence to us in respect of such material.

Are used by us as trademarks.

• You may view the Site and are welcome to print hard copies of any material on it for your personal, non-commercial use. You must not use the contact details given by private advertisers of vehicles other than in connection with a genuine enquiry relating to the purchase by you of the vehicle in question. All other copying whether electronic, hard copy or other format is prohibited. We reserve the right to take action against anyone in breach of these copyright restrictions.

• Warranties
• This Site is provided “as is” and whilst every care has been taken to ensure that the information given in the Site is correct, we give NO WARRANTIES in respect thereof. Specifically, but without limitation, we do not warrant that:
• the Site is free from technical inaccuracies, and typographical errors of any kind; or
• you will be able to use the Site or that it will continue to be made available in its current or any other form; or that the Site or any software of whatsoever nature available or downloaded from it will be free from viruses or defects, compatible with your equipment or fit for any purpose; or
• any material or information contained on this site will be true, accurate or complete.
• Except to the extent otherwise set out in these Conditions or any other terms and conditions on this Site, any warranties which would otherwise be implied by law (Including without limitation, warranties as to satisfactory quality, fitness for purpose or skill and care) are, to the fullest extent that the law permits, excluded.

• Limitation of Liability
• Except in the case of personal injury or death directly caused by our negligence, our liability to you whether in contract, negligence, or otherwise, ad whether arising in relation to the Services or otherwise howsoever, shall in all circumstances be limited to [£10]. • Sites to which you link through the Site (including without limitation any site provided by a Partner or other third party but branded as an Autoweb Site) are independent of the Site and we have no control over them and accept no liability in respect of your use or inability to use them or any of the content of such sites.
• We accept no liability with respect to any of the products, information, material or services offered or provided by our Partners or other organisations listed on, or linked to, the Site, nor do we endorse any of those organisations or any of their offerings. • Cancellation

If at any time, you wish to remove the details, and cancel your agreement with us, you may do so, by notifying us in writing to the address provided.
• We reserve the right to remove details relating to your vehicle and your contact details at any time should we consider it necessary or reasonable to do so.

• Privacy Policy

The Privacy Policy set out on the Site forms part of these Conditions. We are committed to protecting your privacy and the Privacy Policy summarises what personal details we may collect from you during your use of the Site and what we will do with them. Any changes to the Privacy Policy will be posted on the Privacy Policy page.

• Miscellaneous
• There may be other terms and conditions on areas of the Site which relate to your use of such areas, all of which together with these Conditions will govern your use of the Site.
• Any notice required to be given under these Conditions must be in writing, addressed to the contact details shown on the Site. Such notice may be by way of e-mail.
• Any failure by us to exercise any right or provision of the Conditions shall not constitute a waiver of that right or provision.
• These Conditions and any matter relating to the Site are governed by English law and the English courts shall have non-exclusive jurisdiction in respect of them.
